Copyright legislation and its scope of application: European perspective

Abstract

The study discusses the personal scope of application of copyright legislation and the determination of the beneficiaries of copyright protection. The relevant provisions of international agreements, such as the Berne Convention, the trips Agreement, and the implications of European Union Law in this regard provide the basic legal framework influencing the scope of application of national legislations.

Catedrático de Derecho internacional privado de la Universidad Complutense de Madrid (ucm), de cuya Facultad de Derecho es vicedecano. Doctor en Derecho (cum laude) por la ucm y Master of Laws (LL.M.) por la Universidad de Ámsterdam. Miembro del European Max Planck Group for Conflict of Laws in Intellectual Property. Fue uno de los redactores de los European Principles on Conflict of Laws in Intellectual Property. Es co-rapporteur del Committee on Intellectual Property and Private International Law de la International Law Association.
